Jury sides with driver in crash with bicyclist

A jury found a bicyclist mostly to blame for a collision with a car that left him with a traumatic brain injury. Daniel J. Kallick was biking with his dog running alongside him. Scott Roberts was driving a pickup truck in the same direction and was on his cell phone. According to an eyewitness, Kallick's dog was tethered to the bicycle, and either the dog pulled or the wind pushed Kallick into Roberts' lane. Roberts testified that he had been in the right lane, but that he moved to the left lane because Kallick was riding erratically. He said Kallick then suddenly veered from the shoulder to the left lane, and Roberts tried to avoid him, but clipped the bicycle with the right side of his truck or the right mirror. The jury found Kallick 60 percent liable and Roberts 40 percent liable.

Patient awarded for alleged botch hip replacement

A patient who claimed a botched hip replacement was awarded $215,118 in a default judgment. Ampara Robinson underwent a total right hip arthroplasty performed by Dr. Arnold Ravdel in Houston. Robinson claimed that Ravdel failed to properly align the cup of the replacement hip with the socket, and he screwed the socket into the bone, preventing re-alignment of the replacement hip. Ravdel was not represented and did not file a response to the suit. Due to the degree of Ravdel's error, the only way to correct the condition was to surgically remove and replace the replacement hip.

Worker who lost leg to heavy pipe recovers $5M

A laborer who lost his leg after a 2,700-pound pipe fell from a flatbed trailer recovered nearly $5 million. Kelvin Graves was dispatched to pick up a load of the pipes even though his flatbed trailer wasn't equipped with pipe stakes to keep the load in place. The first pipe loaded onto the trailer rolled off the side and struck Graves. The truck was being loaded by a worker for Continental Alloys & Services Inc. Big Dog Logistics LLP contracted to arrange for the pick up. Graves' leg had to be amputated at the knee. The jury found Continental 67 percent negligent, Big Dog 15 percent negligent and Graves 18 percent negligent, which reduced his $6.03 million award.
